  • the right of withdrawal;

  • returns and refunds;

  • after-sales assistance relating to online purchases.

DOT WEAR S.r.l., as owner of the Dotout trademark, provides product-related information and technical support without assuming the role of Seller in online sales contracts.

2. Scope and definitions

These General Terms and Conditions of Sale govern purchases of products available on www.dotout.com.

Before placing an order, the Customer is invited to read these Terms carefully. The Terms are made available in a format that allows them to be stored and reproduced.

For the purposes of these Terms:

  • “Consumer” means a natural person who purchases for purposes unrelated to their business, commercial, craft or professional activity;

  • “Professional Customer” means a natural or legal person who purchases in the course of their business, commercial, craft or professional activity;

  • “Customer” means both the Consumer and the Professional Customer, unless a provision is expressly reserved for Consumers;

  • “Product” means any goods offered for sale through the website;

  • “Contract” means the distance sales contract concluded between the Customer and Lunar Sport S.r.l.

The mandatory provisions of the Italian Consumer Code, including those relating to the right of withdrawal and the legal guarantee of conformity, apply exclusively to Consumers.

Purchases made by Professional Customers are governed by the Italian Civil Code and any specifically agreed B2B commercial terms.

In the event of a conflict between these Terms and a mandatory provision applicable to Consumers, the latter will prevail.

3. Product information

The essential characteristics of the Products are described on the relevant product pages on the website.

Photographs, images, colours and graphic representations are provided for illustrative purposes. Minor colour or aesthetic differences may depend on:

  • the device used;

  • screen settings;

  • photographic conditions;

  • textile production processes;

  • manufacturer updates that do not affect the Product’s essential characteristics or functionality.

Technical information is prepared on the basis of data made available by DOT WEAR S.r.l. and any manufacturers or suppliers involved.

Product pages may be updated for future purchases. For each order, the essential characteristics and information shown to the Customer at the time the Contract was concluded will remain applicable.

Before purchasing, the Customer must check:

  • size;

  • measurements;

  • fit;

  • composition;

  • intended use;

  • technical characteristics;

  • washing and maintenance instructions;

  • compatibility of the Product with the intended activity;

  • any limitations stated on the product page.

Size guides are provided for guidance only. Fit may vary depending on the model, fabric, garment construction and the Customer’s physical characteristics.

In case of doubt, the Customer is invited to contact customer service before purchasing.

4. Prices, taxes, charges and promotions

The applicable prices are those displayed on the website when the order is submitted.

For purchases intended for the European Union and Switzerland, prices displayed to Consumers include applicable taxes, unless otherwise expressly stated before the order is completed.

Shipping costs, any surcharges and all other applicable costs are shown before the Customer submits the order.

For shipments to countries outside the European Union and Switzerland, the checkout indicates, where possible, whether:

  • local taxes;

  • customs duties;

  • customs-clearance charges;

  • import charges;

are included in the amount paid.

Where these amounts are not expressly included, they may be requested from the recipient by the authorities, carrier or customs operator and will remain the Customer’s responsibility.

Promotions, discount codes and offers are valid subject to the stated conditions and for the period indicated. Unless otherwise stated, promotions cannot be combined.

In the event of a clear and recognisable pricing error, the Seller will inform the Customer before shipment. The Customer may:

  • confirm the purchase at the correct price; or

  • cancel the order and receive a full refund of any amounts already paid.

Once the Contract has been concluded, the order price cannot be changed unilaterally.

5. Purchase procedure

To make a purchase, the Customer must:

  • select the desired Products;

  • choose the size, colour and other available variants;

  • add the Products to the shopping cart;

  • check the Products and quantities;

  • enter the required information;

  • select the shipping method;

  • select the payment method;

  • check the order summary;

  • accept these Terms;

  • submit the order by means of a button clearly indicating the payment obligation.

Before submitting the order, the Customer may identify and correct input errors and verify:

  • the selected Products;

  • variants and sizes;

  • quantities;

  • total price;

  • taxes;

  • shipping costs;

  • delivery address;

  • payment method.

Submitting the order creates an obligation to pay the stated amount.

The languages available for concluding the Contract are those selectable on the website.

6. Conclusion and storage of the Contract

The order submitted by the Customer constitutes an offer to purchase.

Automatic acknowledgement of receipt confirms that the system has received the order but does not necessarily constitute final acceptance.

The Contract is concluded when the Customer receives confirmation of acceptance of the order from the Seller at the e-mail address provided.

The confirmation contains at least:

  • order number;

  • Customer details;

  • Products purchased;

  • size and variants;

  • quantities;

  • price;

  • applicable taxes;

  • shipping costs;

  • delivery address;

  • payment method;

  • a link or reference to the applicable Terms.

The Customer must check that the information in the confirmation is correct and promptly report any errors.

The Contract is stored electronically for the period necessary for its performance and for the periods required by applicable tax, administrative and civil law.

The Customer may view order information through their account, where available, or request a copy from customer service.

The Seller may refuse or cancel an order, in particular in the event of:

  • unauthorised or incomplete payment;

  • incomplete or clearly incorrect information;

  • subsequent unavailability of the Product;

  • a clear error in the price or description;

  • quantities incompatible with a normal retail purchase;

  • a well-founded suspicion of fraud;

  • unlawful use of the website;

  • inability to deliver to the stated destination;

  • breach of these Terms.

If a paid order is cancelled, the amounts collected will be refunded without undue delay.

7. Product availability

Availability shown on the website is updated on the basis of available inventory-management data but may change during the purchasing process.

The presence of a Product in the shopping cart does not guarantee its availability until the Contract is concluded.

Where a Product becomes unavailable after the Contract has been concluded, the Seller will promptly inform the Customer and offer, at the Customer’s choice:

  • a refund for the unavailable Product and shipment of the other Products;

  • waiting for the Product to be restocked;

  • an alternative Product, subject to the Customer’s express acceptance;

  • cancellation of the entire order and refund of the amounts paid.

The Customer is not required to accept a replacement Product.

8. Pre-order Products or Products with delayed availability

Products described as:

  • pre-order;

  • available on request;

  • orderable;

  • available from a future date;

are subject to the timeframes stated on the relevant product page or during checkout.

Availability dates are normally estimates and may change due to production or supply times.

In the event of a significant delay, the Customer will be informed and may choose to:

  • keep the order;

  • modify the order, where possible;

  • cancel the affected Product and receive the relevant refund.

9. Payments

The payment methods shown at checkout at the time of purchase are accepted.

Payments are managed through systems and providers that comply with applicable security standards.

The Seller does not directly retain full card details where these are processed by the payment-service provider.

If payment is:

  • unauthorised;

  • refused;

  • revoked;

  • cancelled;

  • incomplete;

the order cannot be processed.

For bank-transfer payments, where available, the order may be processed after the amount has actually been credited.

The Customer declares that they are authorised to use the selected payment method.

10. Invoicing

Invoices and other tax documents relating to online purchases are issued by Lunar Sport S.r.l.

Customers requiring an invoice must provide complete and correct information by the time stated during checkout or, in the absence of specific instructions, before the tax document is issued.

The Customer is responsible for the accuracy of the tax information provided, including:

  • company name or personal name;

  • address;

  • VAT number;

  • Tax Code;

  • recipient code;

  • certified e-mail address.

After the document has been issued, it may not be possible to amend the details, except in the cases and according to the procedures permitted by tax law.

11. Shipping and delivery

Orders are normally prepared within the timeframes shown on the website, product page, shopping cart or during checkout.

Preparation times are separate from transit times.

Delivery methods, costs and estimated times are shown before the order is completed.

Estimated times may vary depending on:

  • destination;

  • availability;

  • public holidays;

  • high-volume periods;

  • weather conditions;

  • customs inspections;

  • strikes;

  • transport disruptions;

  • events that cannot reasonably be controlled by the Seller.

Unless otherwise agreed, delivery to the Consumer will take place without unjustified delay and in any event within 30 days from conclusion of the Contract.

Where delivery does not take place within the agreed period or within the period required by law, the Consumer may require the Seller to complete delivery within an appropriate additional period.

If the additional period also expires without delivery, the Consumer may terminate the Contract, without prejudice to cases in which applicable law permits immediate termination.

In the event of termination due to non-delivery, the Seller will refund the amounts paid in relation to the terminated Contract without undue delay.

The Customer must provide a complete and correct address and ensure that delivery can be received.

Any actual and documented costs incurred due to:

  • an incorrect address;

  • an incomplete address;

  • failure to collect;

  • unjustified refusal;

  • a new shipment requested by the Customer;

may be charged within the limits permitted by law.

12. Partial shipments

Where an order contains multiple Products, Lunar Sport may make one or more separate shipments where necessary or appropriate.

The Customer will receive the available tracking information for each shipment.

If separate shipment is arranged by Lunar Sport, no additional costs will be charged beyond those accepted when the order was placed.

13. Transfer of risk

Purchases made by Consumers

The risk of loss of or damage to the Products passes to the Consumer when the Consumer, or a third party designated by the Consumer other than the carrier, takes physical possession of the Products.

Handing the parcel to the carrier selected by the Seller does not transfer transport risk to the Consumer.

Where the Consumer independently appoints a carrier not proposed by the Seller, risk passes to the Consumer when the Product is handed over to that carrier.

Purchases made by Professional Customers

In dealings with Professional Customers, unless otherwise agreed in writing or under different agreed delivery terms, the delivery obligation is considered fulfilled when the Products are handed over to the carrier or freight forwarder.

From that time, transport risks are borne by the Professional Customer, without prejudice to any rights against the carrier and the Seller’s mandatory liabilities.

14. Inspection of Products upon delivery

Upon receipt of the parcel, the Customer is invited to check:

  • the integrity of the packaging;

  • the absence of openings or tampering;

  • the presence of cuts, crushing or wet areas;

  • the number of parcels;

  • whether the Products received correspond to the order;

  • any visible damage.

Where the packaging is damaged, open, tampered with or wet, we recommend accepting delivery subject to a specific reservation and describing the damage on the carrier’s document.

The Customer is invited to document the issue with photographs and promptly contact customer service.

Failure to make a reservation or report the issue within a short period does not automatically result in the loss of mandatory Consumer rights.

15. Cancellation of the order before shipment

The Customer may request cancellation of the order before shipment by contacting customer service or using any relevant function available on the website.

The Seller will make reasonable efforts to accommodate the request.

Once preparation has started or after the parcel has been handed over to the carrier, it may no longer be possible to stop the shipment.

In that case, the Consumer may exercise the right of withdrawal after delivery in accordance with these Terms.

16. Consumer’s statutory right of withdrawal

The Consumer has the right to withdraw from the Contract without giving any reason and without penalty within 14 calendar days.

The period begins on the day on which the Consumer, or a third party designated by the Consumer other than the carrier, takes physical possession of the Products.

In the case of a single order covering multiple Products delivered separately, the period begins on the day the final Product is delivered.

In the case of delivery of a Product consisting of multiple lots or pieces, the period begins upon delivery of the final lot or piece.

16.1 How to communicate withdrawal

The Consumer may exercise the right of withdrawal by means of an explicit statement through one of the following channels:

  • the online withdrawal function, where available on the website;

  • the returns portal available at www.dotout.com/a/return;

  • an e-mail sent to [E-COMMERCE CUSTOMER SERVICE E-MAIL];

  • the model withdrawal form included at the end of these Terms;

  • any other unequivocal statement indicating the decision to withdraw.

The communication should state:

  • first name and surname;

  • order number;

  • Product or Products concerned;

  • date of receipt;

  • e-mail address used for the order.

To meet the deadline, it is sufficient to send the communication before the 14-day period expires.

Providing a reason is not required.

Any RMA, NAR or case number assigned by the Seller is used exclusively for organisational purposes and is not a condition for the validity of the withdrawal.

16.2 Returning the Products

After communicating the withdrawal, the Consumer must return the Products without undue delay and in any event within 14 days from the communication.

The deadline is met if the Product is handed over to the carrier before the period expires.

Unless otherwise instructed by customer service or through the returns portal, the Products must be sent to:

LUNAR SPORT S.R.L. – Dotout Returns
Via Gianfranco Miglio 2
21045 Gazzada Schianno (VA)
Italy

The Consumer bears the direct cost of the return unless:

  • the Seller has expressly agreed to bear it;

  • an incorrect Product was received;

  • the Product arrived damaged;

  • the Product has a lack of conformity;

  • the return results from an error attributable to the Seller.

The Consumer may use a carrier of their choice.

Use of a tracked shipping service and retention of the receipt are recommended. Shipment insurance is optional.

16.3 Condition of the Products during the first 14 days

The Consumer may handle and try the Product to the extent necessary to establish its:

  • nature;

  • characteristics;

  • size;

  • fit;

  • operation.

The trial must be equivalent to what would reasonably be permitted in a physical store.

Simply opening the packaging does not automatically result in loss of the right of withdrawal.

Likewise, the absence of or damage to the original packaging does not automatically result in refusal of the withdrawal.

However, the Consumer is responsible for any reduction in value resulting from handling or use beyond what is necessary to inspect the Product.

17. Worn, used, washed or damaged Products

The right of withdrawal does not mean that the Product may be freely used during the 14-day period.

By way of example, the following may result in a reduction in value:

  • use of the garment during sporting activity;

  • washing or treatment of the Product;

  • the presence of sweat, odours, deodorant or perfume;

  • the presence of stains, dirt or residues;

  • wear or contamination of the chamois pad;

  • permanent removal of or damage to labels;

  • damage to hygiene protection;

  • abrasions, tears or deformation;

  • use of gloves, socks, shoe covers or technical underwear;

  • use of a helmet during sporting activity;

  • scratches, impacts or marks on helmet surfaces;

  • modification or cutting of straps, padding or components;

  • loss of accessories, spare parts or documentation;

  • damage to packaging beyond what is necessary to open it;

  • use of the commercial packaging as the sole shipping packaging.

After receiving and inspecting the Product, Lunar Sport may:

  • issue a full refund where there is no reduction in value;

  • apply a proportionate and documented reduction;

  • in cases of particularly serious loss of value, issue a refund corresponding to the Product’s actual residual value.

Any reduction does not constitute an automatic penalty and must be linked to the actual economic loss identified.

Where a reduction is applied, the Customer will receive a communication containing:

  • the inspection outcome;

  • the issue identified;

  • any photographic documentation;

  • the criterion applied;

  • the amount of the refund granted.

18. Specific guidance for clothing and accessories

To inspect a garment without compromising its value, we recommend:

  • trying it on over clean clothing;

  • carrying out the fitting in a clean environment;

  • not using it during sporting activity;

  • not washing it;

  • not permanently removing the labels;

  • not applying deodorants, perfumes, creams or cleaning products;

  • not soiling or damaging fabrics, chamois pads, zips and inserts;

  • retaining the packaging, accessories and documentation.

Padded garments, technical underwear, socks and other Products intended for direct contact with the body must be tried on using normal hygiene precautions.

Actual use, washing or the presence of odours and residues may prevent the Product from being resold as new and may result in a significant reduction in the refund.

19. Specific guidance for helmets

To inspect a helmet without compromising its value, we recommend:

  • checking size and fit without using it during sporting activity;

  • making only the adjustments required for fitting;

  • not removing labels or protective materials;

  • not modifying straps, padding or adjustment systems;

  • not applying stickers or accessories;

  • avoiding impacts, falls, scratches or deformation;

  • retaining the packaging, manuals, padding and accessories.

A helmet that has suffered an impact or fall may no longer be suitable for resale or use, even where there is no immediately visible damage.

Actual use or damage may result in a significant reduction in the refund.

20. Commercial return extension up to 30 days

In addition to the statutory 14-day right of withdrawal, Lunar Sport grants Consumers the commercial option of requesting a return up to the 30th calendar day from delivery.

From the 15th to the 30th day, the return constitutes a voluntary commercial concession and does not amend or limit the statutory right exercisable during the first 14 days.

To be accepted under the commercial extension, the Product must:

  • be intact and clean;

  • not have been used;

  • not have been worn during sporting activity;

  • not have been washed;

  • show no odours, stains, dirt or residues;

  • show no wear, scratches or deformation;

  • be complete with accessories, manuals, components and labels;

  • have any hygiene protection intact;

  • where reasonably possible, be returned in intact original packaging suitable for resale.

For returns requested from the 15th to the 30th day:

  • return costs are borne by the Customer;

  • the risk of the return shipment is borne by the Customer until delivery;

  • the price of accepted Products is refunded;

  • the original delivery costs are not refunded;

  • the refund is issued after receipt and inspection;

  • the Seller may refuse Products that do not meet the stated conditions;

  • the refund is normally issued using the same payment method used for the purchase.

The commercial extension does not apply to:

  • Products excluded from the right of withdrawal;

  • personalised Products;

  • Products identified as non-returnable before purchase;

  • Products that have been used, washed or are no longer suitable for sale as new.

21. Exceptions to the right of withdrawal

The right of withdrawal is excluded only in the cases provided by applicable law.

In particular, where applicable and clearly communicated before purchase, withdrawal may be excluded for:

  • Products made to measure;

  • Products clearly personalised according to the Customer’s specifications;

  • goods that, after delivery, become inseparably mixed with other goods;

  • sealed goods that are not suitable for return for health-protection or hygiene reasons and have been unsealed after delivery;

  • other Products or contracts excluded by law.

Simply opening ordinary commercial packaging does not automatically exclude the right of withdrawal.

The hygiene exception applies only where the statutory requirements are actually met, including the presence of an appropriate seal and its removal after delivery.

22. Discounted, promotional and Special Sale Products

Products purchased:

  • on promotion;

  • using a discount code;

  • during commercial campaigns;

  • at a reduced price;

  • from the Special Sale or outlet section;

benefit from the statutory right of withdrawal where purchased by a Consumer and where no specific statutory exception applies.

The mere fact that a Product was purchased at a reduced price does not remove the statutory right of withdrawal.

Any restrictions applicable to the commercial extension from the 15th to the 30th day must be clearly communicated before purchase.

23. Refund in the event of statutory withdrawal

Where withdrawal is validly exercised during the first 14 days, the Seller will refund:

  • the price of the affected Products;

  • the taxes paid;

  • the cost of the original delivery corresponding to the least expensive standard delivery method offered.

Additional costs resulting from the choice of:

  • express shipping;

  • premium delivery;

  • additional services;

  • delivery methods more expensive than the standard option;

are not refunded.

The refund will be issued without undue delay and in any event within 14 days from the date on which the Seller was informed of the decision to withdraw.

The Seller may withhold the refund until:

  • it has received the Products; or

  • the Consumer has demonstrated that they have returned them;

whichever occurs first.

The refund will be issued using the same payment method used for the purchase, unless the Consumer has expressly agreed to a different method and does not incur additional costs.

24. Incorrect, incomplete or damaged Products

If the Customer receives an incorrect, incomplete or damaged Product, they are invited to contact customer service promptly and provide:

  • the order number;

  • the Product concerned;

  • a description of the issue;

  • photographs of the Product;

  • photographs of the internal and external packaging;

  • a photograph of the shipping label, where useful.

Photographs are useful for speeding up handling of the case, but their absence does not automatically result in loss of the rights granted by law.

Where the issue is attributable to the Seller or to transport arranged by the Seller, the costs necessary for collection or return are not borne by the Customer.

The procedure under this clause does not limit rights arising under the legal guarantee of conformity.

25. Legal guarantee of conformity for Consumers

Products sold to Consumers by Lunar Sport S.r.l. are covered by the legal guarantee of conformity provided by Articles 128 et seq. of the Italian Consumer Code.

Lunar Sport S.r.l., as Seller, is liable for lack of conformity existing at the time of delivery and becoming apparent within two years from delivery of the Product.

The action to enforce lack of conformity that was not fraudulently concealed by the Seller is subject to the limitation period provided by law, equal to 26 months from delivery.

There is no two-month forfeiture period from discovery of the defect for contracts governed by the legislation currently in force.

Unless proved otherwise, lack of conformity becoming apparent within one year from delivery is presumed to have existed at the time of delivery, except where that presumption is incompatible with the nature of the Product or the nature of the defect.

After the first year, the Consumer may be required to prove that the cause of the defect was already present at the time of delivery.

25.1 Product conformity

A Product conforms to the Contract where, among other things, it:

  • corresponds to the description;

  • possesses the promised qualities, functionality and characteristics;

  • is suitable for the particular purpose communicated to and accepted by the Seller;

  • is suitable for the purposes for which Products of the same type are normally used;

  • has the quality, safety, durability and compatibility that the Consumer may reasonably expect;

  • is supplied with the required accessories and instructions.

25.2 Available remedies

In the event of lack of conformity, the Consumer is entitled to have conformity restored by:

  • repair; or

  • replacement.

The Consumer may choose between repair and replacement, unless the chosen remedy is impossible or would impose disproportionate costs on the Seller compared with the alternative remedy.

Repair or replacement will be carried out:

  • free of charge for the Consumer;

  • within a reasonable period;

  • without significant inconvenience;

  • taking into account the nature of the Product and the purpose for which it was purchased.

In the cases provided by law, the Consumer may obtain:

  • a proportionate reduction in the price; or

  • termination of the Contract.

Termination is not available where the defect is minor, unless otherwise provided by law.

25.3 Exclusions

The legal guarantee does not cover defects or damage resulting from:

  • normal wear;

  • improper use;

  • use contrary to the Product’s intended purpose;

  • failure to follow instructions;

  • improper washing or drying;

  • use of incompatible detergents, bleach or fabric softeners;

  • exposure to temperatures or heat sources that are not permitted;

  • accidents, falls or impacts;

  • inadequate maintenance;

  • unauthorised modifications or repairs that caused the defect;

  • particularly intensive use incompatible with the Product specifications;

  • normal deterioration of colours, fabrics and components resulting from use and washing.

The exclusion applies only where the damage or defect is causally linked to the relevant conduct or event.

25.4 How to request assistance

To request warranty assistance, the Consumer may contact customer service and provide:

  • order number;

  • Product concerned;

  • description of the defect;

  • date on which the defect was identified;

  • any useful photographs or videos;

  • washing and use methods, where relevant.

The Consumer may prove the purchase by means of:

  • an invoice;

  • order confirmation;

  • receipt;

  • payment statement;

  • other suitable evidence.

Where the Product must be returned for inspection, repair or replacement, the Seller will provide the necessary instructions.

Costs necessary for collection, return, repair or replacement under the legal guarantee are borne by the Seller.

Any commercial warranty offered by DOT WEAR S.r.l. is additional to the legal guarantee and does not replace or limit it.

26. Guarantee for Professional Customers

The legal guarantee under the Italian Consumer Code does not apply to purchases made by Professional Customers.

Unless a different commercial warranty is expressly granted, the provisions of the Italian Civil Code concerning warranties for defects and lack of promised qualities apply.

The Professional Customer must inspect the Products promptly and report any defects within the periods required by law or under specifically agreed B2B terms.

27. Liability and use of the Products

The Seller is liable for performance of the Contract and for the Products sold within the limits provided by applicable law.

Nothing in these Terms excludes or limits the Seller’s liability where such exclusion or limitation is not permitted by law.

The Customer is responsible for selecting the Product and using it in accordance with:

  • its technical characteristics;

  • its intended use;

  • instructions;

  • warnings;

  • washing instructions;

  • maintenance instructions.

The Seller is not liable for damage caused by improper use, incorrect washing, inadequate maintenance or failure to follow instructions, unless those events are attributable to the Seller or exclusion of liability is not permitted by law.

Helmets and protective equipment must be used, adjusted, stored and replaced in accordance with the manufacturer’s instructions.

After an impact or fall, a helmet may require replacement even where there is no immediately visible damage.

28. Force majeure

The Seller is not liable for delays or non-performance caused by unforeseeable events that cannot reasonably be controlled, including:

  • natural disasters;

  • war;

  • riots;

  • measures taken by authorities;

  • public-health emergencies;

  • general strikes;

  • customs blockages;

  • exceptional transport interruptions;

  • widespread unavailability of IT or energy networks;

  • fires;

  • flooding;

  • similar force-majeure events.

Mandatory Consumer rights concerning delivery, refunds and termination of the Contract remain unaffected.

29. Intellectual property

Trademarks, trade names, text, photographs, videos, drawings, technologies, graphics and other content on the website belong to DOT WEAR S.r.l., Lunar Sport S.r.l., their respective owners or are used under authorisation.

Reproduction, distribution, modification or use of the content without prior authorisation is prohibited, without prejudice to uses permitted by law.

The Dotout trademark and its distinguishing signs may not be used without the relevant owner’s authorisation.

30. Processing of personal data

Personal data collected during:

  • browsing;

  • registration;

  • purchasing;

  • payment;

  • shipping;

  • returns;

  • refunds;

  • after-sales assistance;

is processed as described in the Privacy Policy available on the website.

The complaint must contain the information necessary to identify:

  • the Customer;

  • the order;

  • the Product;

  • the reported issue.

The Seller will examine the complaint and provide a response within a reasonable period.

32. Alternative dispute resolution

The Consumer may refer disputes arising from sales contracts to the competent alternative dispute-resolution bodies, known as ADR bodies.

The list of recognised ADR bodies can be consulted through the official channels of the Italian Ministry of Enterprises and Made in Italy and the other competent authorities.

The Seller may participate in an ADR procedure where:

  • required by law;

  • it has made a specific commitment;

  • it agrees to participate in relation to the individual dispute.

The former European ODR platform for online dispute resolution has been discontinued and the relevant Regulation repealed; therefore, no link to the platform is provided.

33. Applicable law and jurisdiction

These Terms and Contracts concluded through the website are governed by Italian law.

Where the Customer is a Consumer resident in another country, any more favourable mandatory provisions under the law of the Consumer’s country of habitual residence remain unaffected.

Any dispute involving a Consumer will be subject to the court determined under the applicable mandatory provisions and, where provided, the court of the Consumer’s place of residence or domicile.
